virtual cruise from hell? hello and welcome to "justice." i'm judge jeanine pirro. it is sunday morning, day three of a four day cruise. fire erupts and all of the power goes out and for the next five days 4200 people on carnival's cruiseship triumph are adrift on a ship without power. that means no hot water. no electricity. no running toilets. and no real food. so much for the unlimited buffet. so it left me looking for answers. what is the history of this ship? did it have any previous problems? alas, just a few weeks earlier the same ship had an engine room problem that caused its cruises to be canceled. and lest i forget, this is a carnival cruiseline.

engine fires not really uncommon. last year the casa' alegra a fire in the engine room causes it to go adrift. the spendor, 2010, fire in the engine room, adrift. the ecstasy. the star princess. the royal princess. each with their own problems. get my drift? >> there was no water -- >> why there was no emergency plan in place? passengers report total chaos walking on urine soaked feces encrusted floors eating ketchup and onion sandwiches. and i brought some here for you. ketchup and onions. so i say why wasn't food air dropped for these people. we do it for foreign countries all the time. >> people started hoarding food into their bags and back packs and were running away with food and then there was food

shortages and they kept stopping serving food so you would go up and there would about he no food and you would be waiting in line for hours on end. >> judge jeanine: why did it take so long to get a generator. another cruiseship dropped off hamburgers and chicken from which it is reported many became sick and over which fights erupted over why there was no provision for wheel chair bound passengers? since the elevator didn't work they were held captive on the floor they were on. >> we are focused on our guests and getting them on their jurisdictionry home. >> judge jeanine: really? when the power went out if you were so focused on getting your guests home. the ship was 150-miles from mexico. 500 miles from alabama. the math is simple. since the cruise is over the next day go to mexico. get them home. but the decision was made to go

to alabama. could it be because it was cheaper to go to the states? then you only have to bus people home and they had about 100 buses versus paying for airfare from mexico? plus why put more miles on the ship. >> it could have been a serious catastrophe really. so they are just very lucky that we didn't end up burning in the ship because no alarms went off. they told us to go back to bed while the fire was burning. >> but isn't it interesting that the last night, the passengers received for their last supper steak and lobster. for their closeup, carnival cruise lines doesn't allow the old ketchup and onion sandwich. the deck is pristine. no longer smelling of feces and

urine. urinein strong enough to burn your eyes and the feces crusting on your toes. then they had the music play on. what is the recourse? the ticket language limits the ability to recover and even sue. maritime law bars passengers from recovering damages from emotional stress. unless you have been physically injured i no damages. i think congress needs to get involved because the rights are cruiseship passengers are almost nonexistent at a time when the business is literally exploding. what is that you say? this will be investigated. yes. but by whom? oh, yeah, the bahamaian government. isn't that where an attempt was made to blackmail john travolta right after his own son died.

i have always believed the punishment should fit the crime. here is my sentence. all execs of carnival including the ceo will be sentenced as follows. their jail cell a porta potty and a smelly one at that. conditions of their incarceration that they walk in feces encrusted and urine soaked rugs, have no shower and no water and eat the old bread onions and ketchup sandwich and they are fined $10,000 times 4,200 people. and by the way that includes the crew members who literally prevented an all out mutiny. with me is matt who with his wife was a passenger on the carnival triumph. he plans to sue carnival in a class action. he joins us from oklahoma city and also with us michael

winkleman, matt's attorney. you were a marine. how bad was it? >> conditions were pretty bad. everything you said so far is very accurate. the beginning when the fire broke out at 5:30 in the morning everybody scrambled to the muster stations and really didn't know what was going on. >> judge jeanine: did they tell you that there was a fire? >> not initially. but you could smell the smoke bellowing through the hallways. >> judge jeanine: do you think the ship was prepared for even the possibility of this happening? >> that is really why i came on it because i don't think that they were well prepared. their history shows that they are blatantly negligent to implement contingency plans to ensure passenger safety. >> judge jeanine: and so what happened to those individuals

who were in wheel chairs, the elderly, i understand that a woman cracked her head an elderly senior citizen, that a girl, someone broke her ankle and her foot was hanging from her leg. i mean did you see all this, matt? >> i did. i saw the -- i felt bad for the young children, the babies who were on a limited is you ply of diapers. they were rationing out the diapers that were onboard. the elderly were pretty much stuck where they were at with no way of getting anywhere and people would just bring them food. >> judge jeanine: yeah. michael, i'm going go to you. you represent matt. what is the basis of his claim and can you really expect to recover given the fact that there is limited liability pursuant to the ticket?

>> sure. first, good evening, your honor. nice to see you. thanks for having me back and matt and all of the 3,000 passengers absolutely have a right to file a claim. it is eception isly a combination of negligence infliction of emotional disclaim and intentional infliction of emotional distress claim. >> you need to show physical injury, don't you? for all of the people who suffered the stress of backing through the feces infested carpets and fighting over food and the mess that is emotional trauma. is that recoverable? >> it absolutely is, judge. you are talking about the zone of danger test and in some jurisdictions it does require a physical manifestation and from what i heard and seen the evidence will openly show from the facts that all of these people have a right to recover under the law for negligence infliction of emotional duress and intentional infliction of emotional distress. >> judge jeanine: why would you

say intentional? >> i do. i think you were hitting the hail on the head. it was about putting profits over people's safety. when they were 150 miles from mexico they intentionally decided to go 500 miles away back to the united states for money. instead of getting the people off the ship they he intentionally decided to drag them across the gulf of mexico for five grueling awful days and subjected them to the awful deplorable conditions. >> judge jeanine: add to the fact that for five extra days people weren't able to plan for baby sit isers, pet sitters, you get your check stolen in the mail. >> they couldn't work. they are losing wages. you got it, judge. >> judge jeanine: $500 doesn't cover any of that. >> none of it. i called it laughable and i think that is a valid statement and i know matt feels the same way about it. really almost insulting. why does carnival get to pick a number out of thin air as to what they think is fair for this. a jury should ultimately decide

avoided? joining me is former ntsb former board member dr. vernon gross. thanks for being with us this evening. >> you're welcome, your honor. >> judge jeanine: the reports are there were problems with the ship just weeks before it left on this cruise. what can you tell us about this? >> well, we know good and well, there is no mystery here at all. you recited a bit already of what i would call indictment of what they have done. the one fact that we need to know here that there is no regulation for cruiseships. they are not regulated like airlines are or railroads. or other modes of transportation. because of that, you know, there is no way to govern what they are doing. there is no way to have leverage on them if they do fail like they have done now. >> judge jeanine: let me ask you this. when you say not like the airlines. why is the cruiseship industry so different? it is a carrier of many guests who pay to get on them.

incorporated some of them in miami. why is there so much or a total lack of almost regulation of these cruiseships? >> well, i think they have gotten away so far from having regulation but there is a variety, a spectrum of cruiseship companies and i hope that the whole cruiseship industry is not judged by this one incident that just happened. this is like the wal-mart of cruiseships as i understand it. it is -- they have lower rates and so on and so they get away with a lot more than the more sophisticated ones would. here is the crest in my mind, why did this fail, this engine fail in the first place because they had one fail before, two years ago off mexico, carnival lost one as well. >> the splendor. this is not unusual. they go adrift all the time. is there any deterrent to or any punishment to these people

being derelict in making sure that these ships are are ready to go out of port again? >> this is a bahamian registration and they will conduct the investigation. the nt is sb and the coast guard will be parties to that. but they will not probably have the leverage that you would have if it was done by the ntsb. >> judge jeanine: doctor, with all due respect you were a member of the national transportation safety board. they have no jurisdiction here other than to recommend changes. nobody is going to punish carnival for this and deal unless they get a class action going here. with the trauma and stress of not having food, fighting in lines to get food. it is like a third world country. >> it really was. i'm hopeful that maybe the publicity that this created might cause them just from conscience sake to do some things they should be doing. for example, why did that engine catch fire? we need to know that. but if it caught fire, why in the world does all of the power

on the ship focused in that one engine? they should have an auxilliary power unit for scam. >> and the generator comes in the day before they go into alabama. if we air drop food for foreign countries all the time and you have people without medication because they are on the boat five days longer than they should have been, what is the problem with at least trying to get the staples that people need? >> well, if you you stop to think about this, who paid even for the towing of this ship back to mobile? >> judge jeanine: the coast guard. we did. >> yes, the taxpayers paid for that towing so they got that free. >> judge jeanine: they he ought to be forced to reimburse for that and 500 buck bucks is hog. it is not enough money. thanks for being with us this evening. >> you're welcome. >> judge jeanine: coming up, she has been on the stand for weeks in her own murder trial.

vibe about her from day one. today looking back it is easy to describe it as no soul but there was something she didn't click with any of our groups. we never knew much about her and she didn't open up and talk much about her background and travis normally dated girls that were easy to communicate with and talked with and got along with the rest of us very easily. >> judge jeanine: looking back on it now, do you think that he had feelings for her or was this just a sexual relationship? >> well, i know that travis con fided in some of his close friends that they had had some let's call it morality challenges and that he was working through those and trying to get through those but get slipping up and going back to her. quite honestly. >> judge jeanine: let me see if i underand it this. he had a morality challenge? what does that mean? >> what that means is according

to the beliefs of our church there is some morality rules and some guidelines that we believe are inappropriate if you are not married and he had been messing up and violating those rules. >> judge jeanine: does that mean he shouldn't have had intercourse with her? >> that's correct. >> judge jeanine: so he shouldn't have premarital relations. >> correct. >> judge jeanine: that tape recording, it was his voice, something about raping jodi. does that surprise you to hear that in your friend's voice? >> you know, it doesn't surprise me from the standpoint of jodi an in that type would y things like you are so bad that is so debasing and i love i'm looking for a return missionary that is even more freaky. the challenge was to travis i want that freaky guy, i someone that can really be this love slave to me and so he would

talk dirty to her and try to raise the bar and excite her more. i think they were both engaged in consentual dirty talk with each other. >> judge jeanine: let's assume they were. she says that travis was controlling. do you think that is the case? >> well, if you listen to that tape there is no controlling in there whatsoever. >> judge jeanine: all right. >> we have jodi on the stand now says she felt used and abused like used toilet paper and that she was faking it. well, that is easy to say after you had five years to sit in prison and talk to psychologists and attorneys. >> judge jeanine: patty, you are on the phone right now. were you surprised when you heard that jodi killed travis alexander? >> i was really surprised when i heard that she killed travis. >> judge jeanine: how long have you known jodi arias? >> i have known jodi since the 6th grade. >> judge jeanine: since 6th

grade. all right. did you ever think she was capable of killing someone, stabbing them 28 times and basically almost decapitating them? >> absolutely not. the jodi that i knew could never do anything like that. so i mean hearing that, i just think it is drastic measures for jodi to do something like that. >> judge jeanine: had jodi ever spoken to you about her relationship with the victim her, trace gallagher viz alexander? travis alexander. she never complained to you or any one you know that she was being control and that she was a victim? >> no, i lost touch with jodi for about two years before the tragedy happened. >> judge jeanine: so now have you visited her in jail, patty? >> yes, i have. >> judge jeanine: and how does

person who is acting but she can't really act. >> and she acts so well that she doesn't even recognize she is doing it. you look into the eyes there is no emotion. it is not like your twinkle, judge. here feeling is all put away and some place so far you can't even relate to her. >> judge jeanine: but she is not insane and not offering an insanity defense because she lied so many times, right. >> basically a classic textbook case of how not to defend a client charged with murder. >> judge jeanine: why? >> most defense lawyers will tell you they don't want to put the client on the stand unless they have to. when your claim is self-defense you have to but you don't put the client on the stand for six days and have her testify about everything else except why it was self-defense which is what she has done. >> judge jeanine: still on direct now. six day its of testimony and haven't gotten to the fact that she stabbed him 27 times and shot him in the head.

>> judge jeanine: i didn't like her the first day i saw her. >> i think she is moreally insane. >> judge jeanine: i'm not going there yet. alexis, you have been in the courtroom. how does she come across? >> as this meek little girl that has been so tortured. the thing is i have is spoken to so many of travis' friends who have met he peteedly and -- repeatedly and they say this is nothing what she was like in real life. this is a show and they said she is absolutely acting and they can tell because she hesitates when she talks because she is trying to think of what the real story is. >> she is supposedly raising a self-defense claim. she hasn't raised one fact that makes that any kind of justification claim. >> judge jeanine: what was the line that he said if i he raped you. >> that was during phone sex. not okay but doesn't make out a self-defense claim of an imminent threat of harm at the time that he was stabbed

multiple times and shot and slashed from ear to ear. it is like a friend telling you aah long story and never getting to the point. the jury is not the going to care as muc by the end of the story. >> one of the problems in the self-defense case. he was shot and his throat slit and he was stabbed 27 times. that is not self-defense. that is rage. anger. lack of control. >> judge jeanine: let me throw from there the memory card from the camera of his being dragged across the floor she tried to wash in a washing machine. >> when she tells a story like patients i have seen that have severe personality disorder not that i can diagnose here on tv but she paints this landscape but you doesn't put herself in it. all this stuff and where is h her action and her role? she leaves that out. >> is she med kateed. >> she is not overmed kateed. i don't see any signs of her being overly medicate.

>> judge jeanine: what is with the lack of affect? >> that is the cardinal sign of her is severe personality problems. >> most likely she will be convicted. she needs sympathy from the jury so she is not executed at the end. >> judge jeanine: that is off the table. started with the phone sex and maybe they accomplished what they wanted to do. >> i have a problem with the fact that she has been on the stand this long. once she loses credibility with the jury on any issue then when it gets to the meat and potatoes of having to explain why this is self-defense the jury is going to tune her out. >> judge jeanine: does the jury buy any of this? >> in the beginning the jury bought -- everybody else is no. some of them won't even look her in the eye. 11 men and one woman. >> judge jeanine: really? 11 men and one woman? who pickd that jury. that defense right off the bat. >> alexis talks about the jury not looking her in the eye. on the portion of the tape you were playing before her defense

attorney won't even look her in the eye. >> when you stare into the abyss the abyss stares back at you. >> the key thing is eventually she will talk about the day travis alexander was shot and nothing she can say would make out a defense for the reason she stabbed him 27 times. >> she bought -- >> why does she lie about it after and say she wasn't there and then says that two masked intruder hes came in. >> judge jeanine: you know what the answer for that was, why she lied and said she wasn't there because she had never been charged with something before. did you read that? >> and the real reason -- the real reason is they hadn't confronted her with the evidence showing her she was at the scene and then had to change the story to say there were masked intruders. >> judge jeanine: the whole idea of her being a victim is fascinating. let me go to you one last time, doctor, on her issue you of her are ability to kill someone. she has no criminal record.

we know she was jealous because she was taking some other broad, excuse me, sorry, put the camera on me, i'm sorry, from her perspective there was someone else. >> she couldn't tolerate the loss. >> judge jeanine: but there is nothing in her history that says she is capable of killing someone like this. >> the best predicter of violence is a history of violence. here we have one woman who was so fractured in her psyche that she reached out and surprised us all with her rage. a crime of terrible passion but no one saw it coming. >> judge jeanine: and before we alexis isk here, aelection there anything you found out about her that we are not seeing in the courtroom. >> there was no proof that travis bought this underwear for her. never any pictures of her in it.ptember him a picture of h her in it. he loved naked pictures of her. nothing. the only ones that showed up were after heed died.
